René Nuñez of the FSLN was elected President of the National Assembly. It is easy to write this off as a result of the Aleman/Bolaños division. Others will say that it is Aleman and Ortega vs. Bolaños. I have added some external links. There are probably other theories.

Las reformas: pactistas uno, la gente cero

Aunque no me guste, este round se lo tengo que dar a los pactistas. Aprobaron las reformas a la Constitución Política como quisieron y cuando dijeron.

Lo que no van a lograr es que me una al coro que está dando “gracias” por el “entendimiento”. ¿Gracias por qué? ¿No aprobaron abusivamente todo lo que quisieron, sin consultar con nadie? ¿Y cuál entendimiento?, si es la misma trampa de toda la vida.

Si la gente pusiera un poco más de atención a la trampa de los pactistas se daría cuenta que esto de los pleitos es más bien una estrategia. Llevan las cosas al límite, parece que la república se va a desmoronar y después retroceden para salirse con la suya, y la gente respira aliviada de que “estalló la paz”. ¡Por favor!

Uno de los que respiran aliviados es el Gobierno, que al final se conformó con sobrevivir y dejar el problema para el próximo Presidente, que tendrá que lidiar con los diputados de los “partidos mayoritarios”. Lo que no convenga a los caudillos, será vetado.

No hay manera en que los personeros del Gobierno me convenzan de que esto no es así. Antes que se aprobaran las reformas en segunda legislatura, argumentaban que éstas “destruirían el balance entre los poderes del Estado”, por ende darían al traste con el sistema democrático y por eso no podían permitir que fueran aprobadas.

En eso estábamos de acuerdo, pero ahora resulta que con tal de que ese desequilibrio no se dé en los dos años que le quedan a don Enrique Bolaños, todo está bien. ¡Bonito cuento!

Era tanta la desesperación del Gobierno por salvarse, que hasta aceptó como “testigo y garante” a uno del equipo contrario. ¡Qué horror a perder el hueso! Ya ni se acuerdan de las reformas que ellos propusieron.

De este diálogo don Enrique va a sacar la sobrevivencia de su Presidencia, don Daniel va a sacar sus reformas con las que piensa gobernar por siempre “desde abajo” si, como es lo más probable, nunca vuelve a ganar una elección. Y don Arnoldo Alemán saca su libertad.

Como siempre, el que queda por fuera en estos diálogos nefastos es el pueblo, la gente, la ciudadanía.

Lo que sí me parece increíble es que la ciudadanía se vaya a quedar impávida. Acabamos de ser testigos del mayor desparpajo que se puede pensar de una clase política, que negocia y se reparte cargos y poder como botín con un reo condenado; que hace, rompe y retoma acuerdos según su conveniencia; que no le importa poner al país al borde del caos y con ello ahuyentar la inversión, mientras logre su objetivo.

En los próximos días vamos a ser testigos de cómo destrozan los retazos que quedan del Estado de Derecho y la institucionalidad, para hacer calzar en sus intereses las reformas constitucionales, ¿y la ciudadanía, no va a hacer nada?

Si no reaccionamos, entonces nos merecemos a esta clase política y cualquier cosa que se les ocurra hacernos.

Sin embargo hay un rayito de luz. Ya hay movimiento de la gente que está exigiendo un referendo para que sea la gente la que decida si quiere o no estas reformas que han sido aprobadas de manera abusiva.

Ese espíritu debe continuar. Sólo así se barre con tanta basura, como dijo don Emilio Álvarez Montalván. .

El Gobierno que preside Enrique Bolaños, y las dos fuerzas mayoritarias en la Asamblea Nacional, lograron destrabar ayer el impasse surgido por la aprobación de las reformas constitucionales que restringen las atribuciones al Poder Ejecutivo.

Durante una encerrona de más de seis horas en la Universidad Católica (Unica), y con la presencia como testigo del cardenal Miguel Obando, las delegaciones del Gobierno, el Partido Liberal Constitucionalista (PLC) y el Frente Sandinista (FSLN) decidieron que la aplicación de las reformas sea consensuada entre Ejecutivo y Legislativo, en cinco de sus ocho artículos.

Un día antes, liberales y sandinistas aprobaron en segunda legislatura las reformas constitucionales, pero sólo en uno de sus artículos, el referido a la ratificación de funcionarios públicos, contemplaron buscar consenso entre el Ejecutivo y Legislativo, violentando el acuerdo previo firmado entre Bolaños y Daniel Ortega, líder del FSLN.

¿QUIÉN CEDIÓ?

No obstante, el PLC y el FSLN en conjunto con el Ejecutivo acordaron, en la Unica, que las reformas constitucionales serán aplicadas de acuerdo al consenso entre el Ejecutivo y el Legislativo en cuatro artículos más, uno de ellos a medias.

El acuerdo incluyó que durante el período de Gobierno 2002-2007, la destitución de funcionarios públicos deberá implementarse hasta que se logre el consenso entre los tres principales actores políticos del país: los dos grupos parlamentarios mayoritarios y el Gobierno, “de manera que garantice las relaciones armónicas”.

También se acordó que el nombramiento del Superintendente de Servicios Públicos y los cuatro Intendentes, así como el nombramiento del Director y Subdirector del Instituto de la Propiedad, deberá contar con el consenso del Ejecutivo y Legislativo, al menos durante el período de Gobierno 2002-2007.

Los cambios serán incorporados en las reformas constitucionales “vía estilo”, explicaron liberales y sandinistas.

”EL DIÁLOGO SIRVIÓ”

Tras los acuerdos, el cardenal Miguel Obando y Bravo como testigo y anfitrión consideró que en el país “es necesario tratar de buscar cómo dialogar para llegar a un entendimiento”.

“Parece que el diálogo sirvió, por eso quiero felicitarlos a ustedes que han trabajado tanto, y en este trabajo diría que el diálogo ha triunfado, porque han llegado a un acuerdo”, resaltó.

El presidente Bolaños, en representación del Ejecutivo, Ortega del FSLN, y el diputado Noel Ramírez en nombre del PLC, exaltaron la labor del cardenal Obando por facilitar alcanzar un consenso en cuanto al tema de las reformas.

Tanto Bolaños como Ortega y Ramírez se comprometieron a respetar el acuerdo suscrito en la Unica, referido a la aplicación de las reformas constitucionales que restarán atribuciones al Ejecutivo.

Asimismo, anunciaron la instalación del diálogo nacional el próximo miércoles, posiblemente en la Unica.

“CORRECCIÓN DE ESTILO”

El presidente de la Asamblea Nacional, René Núñez, explicó que para ampliar la disposición transitoria en la Constitución, que establece que la implementación de las reformas se hará por consenso entre el Legislativo y el Ejecutivo, se hará mediante una “corrección de estilo”.

“Eso tenemos que verlo con los especialistas, lo que pasa es que ya está un concepto aprobado en la reforma constitucional, eso le da rango constitucional a este acuerdo porque lo incluye en la reforma constitucional, lo que vamos a hacer es a extender esa aprobación que hizo la Asamblea Nacional a otras partes que están comprendidas en el acuerdo y que no había sido específicamente puesta el día de la aprobación”, argumentó Núñez.

La disposición transitoria para la implementación y vigencia de las reformas constitucionales ya no será exclusiva para el Artículo 2, sino que se hace extensivo a los artículos 1, 5 y 6 y así garantizar las relaciones armónicas del Ejecutivo y Legislativo.

“Se ha alimentado la confianza en los tres actores políticos, una confianza que no estaba plenamente cimentada; tomen en consideración que el PLC no tuvo una participación directa en la firma de los acuerdos políticos”, observó Núñez.

INTENSA NEGOCIACIÓN

En determinado momento las conversaciones se trabaron en lo relacionado al Artículo 3 de la reforma constitucional, que establece la elección (con el 60 por ciento de los votos del total de diputados) de funcionarios de Estado y magistrados, ya que los liberales alegaban que es una facultad de la Asamblea Nacional.

No obstante, según fuentes extraoficiales, los facilitadores del Programa de Naciones Unidas propusieron una salida que derivó en el acuerdo que durante el período 2002-2007 en lo referido a los nombramientos del Superintendente de Servicios Públicos y del Director del Instituto de la Propiedad, se efectuará con el consenso de los tres principales actores políticos del país.

Monseñor Eddy Montenegro confirmó que hubo un momento de tensión durante el desarrollo de las pláticas, cuando se realizó un receso muy largo.

“Pero al final, se exhortó a que volvieran a la mesa y ya venían prácticamente cada uno de los sectores con una redacción que ayudaba y colaboraba a que todo mundo cediera un poco y se pudiera dar el compás que se tenía de equilibrio que era necesario para seguir adelante”.

Desde antes que iniciaran las conversaciones, Ortega dijo tener confianza que se lograría un consenso entre los tres actores políticos, y reiteró que nadie violó los acuerdos, sino que eran problemas de interpretación, lo que definió como normal en todo proceso negociador.

“Me parece, estoy convencido en este momento histórico, que ya la voluntad por la reconciliación, por el entendimiento, es mucho mayor que en otros momentos en los que se ha presentado crisis, negociaciones y diálogo”, indicó Ortega.

LA DELGADA LÍNEA DEL CONSENSO

El secretario de la Presidencia, Ernesto Leal, dijo que para alcanzar el consenso sobre los puntos de las reformas constitucionales, los tres principales actores políticos del país, PLC, FSLN y el Gobierno, deben estar de acuerdo, si no, no hay consenso.

"Consenso es llegar a posiciones en que los tres estemos de acuerdo", aseveró Leal.

"No es unanimidad (pero) puede ser un disentimiento reservado, que no es unanimidad, pero hay un consenso", sostuvo.

"El consenso quiere decir satisfactorio para los tres", agregó.

Leal dijo que si una de las partes, ya sea el PLC, FSLN o el Ejecutivo, no está de acuerdo con alguna medida, entonces "no hay consenso".

Sin embargo, luego explicó que "el consenso es una mitología nacional e internacional.

"En los tratados internacionales, en el Sistema de Integración Centroamericana, cuando se habla de consenso es que todos los presidentes tienen un consenso, y el que disienta se reserva y accede al consenso", anotó.

UN ASUNTO DE ESTILO

En medio de un confuso juego, liberales y sandinistas aprobaron ayer unas reformas constitucionales que recortan las atribuciones al presidente Enrique Bolaños, lo que echó por el suelo el acuerdo suscrito entre el mandatario y Daniel Ortega un día antes, según el cual se consensuarían dichas reformas con el Poder Ejecutivo.

La decisión legislativa, propiciada gracias al juego de Ortega, desató de nuevo la grave crisis institucional del país.

En horas tempranas de la tarde, fuentes de la Presidencia aseguraron a LA PRENSA que Bolaños tenía firmado en su escritorio el Decreto de Estado de Emergencia.

Sin embargo, más entrada la noche y luego de la comparecencia televisiva del secretario de la Presidencia, Ernesto Leal, en la que declaraba que el Ejecutivo consideraba la aprobación de las reformas como incumplimiento de lo acordado, el Presidente se reunió en la Curia con Ortega, el cardenal Miguel Obando y el representante de Naciones Unidas, Jorge Chediek, para intentar salvar el acuerdo. Ortega de nuevo se dispuso al diálogo.

En menos de 24 horas, Ortega había cambiando tres veces de posición con respecto a las reformas constitucionales.

Pero Arnoldo Alemán se atrincheró desde El Chile, con una simple posición: “No es posible revertir lo reformado”.

Sin embargo, durante su comparecencia, Leal había lanzado al ruedo la idea de una Ley Marco que le diera una salida política a unas reformas que ya habían sido aprobadas.

La idea fue rechazada ayer mismo por los liberales. Pero hoy se prevé un diálogo tripartito.

El objetivo de la primera mesa de negociaciones entre el Ejecutivo, el FSLN y el PLC, prevista para esta mañana, es precisamente la búsqueda de un mecanismo político o legal para incluir las disposiciones transitorias en cada uno de los artículos de las reformas constitucionales aprobadas ayer en la Asamblea Nacional.

Fuentes extraoficiales señalan que uno de los compromisos del Frente Sandinista durante la reunión, es que si no logran convencer a los liberales para que los apoyen en cualquiera de las medidas que apliquen para solventar lo de las disposiciones transitorias, lo harán mediante una especie de “Ley Marco”.

RECUERDA LEY DE 1995

“Hoy (ayer) también oíamos declaraciones de unos diputados que decían que nunca un acuerdo político podrá sustituir la soberana facultad de la Asamblea Nacional, con todo respeto les digo que hay antecedentes de esto, en 1995 la Ley Marco que se negoció entre el Poder Ejecutivo y el Legislativo de ese entonces, todos dijeron que era un adefesio jurídico y se salvó el país, siguió el desarrollo y siguió la democracia, lo político vale la pena cuando se trata de salvar a Nicaragua”, argumentó el secretario de la Presidencia, Ernesto Leal

Se informó que durante la reunión solicitaron al cardenal Obando que conversara con el ex presidente Arnoldo Alemán para convencerlo de buscar un mecanismo para superar el impasse, no obstante, el líder religioso sugirió que se sentaran de una vez hoy para iniciar el proceso de diálogo. ARREGLO CONO SIN PLC

Se asegura que los sandinistas están dispuestos a cumplir con o sin el respaldo de los liberales, por lo que se espera que la reunión de hoy sea bajo un ambiente tenso.

“Los liberales se sientan, esto (diálogo) arranca mañana, y si no se llega a un consenso, si los liberales no votan, los sandinistas acompañan la Ley Marco y se soluciona todo por esa vía, es decir, que se va a intentar superar el impasse por la vía de la Carta Magna con los liberales, y si no con Ley Marco sin los liberales”, destacó una fuente.

Las reformas constitucionales aprobadas en primera legislatura, son ocho artículos que apuntan a quitarle al Presidente de la República sus facultades como Ejecutivo, teniendo la Asamblea Nacional la potestad de destituir a los ministros y otros funcionarios que dependen de la Presidencia, así como ratificar el nombramiento de los mismos.

El acuerdo básico entre Ortega y Bolaños era asegurar que, si bien las reformas constitucionales iban a ser refrendadas en segunda legislatura, las mismas serían implementadas y puestas en vigencia mediante un consenso entre el Ejecutivo y el Legislativo.

No obstante, al día siguiente, la bancada del FSLN en conjunto con el PLC, que desconoce el acuerdo Bolaños-Ortega, aprobó los ocho artículos iguales a los que habían acordado en primera legislatura, sin incluir la disposición transitoria acordada sobre la implementación y vigencia de las reformas.

¿ORTEGA ENREDÓ TODO?

La interpretación de los sandinistas es que la disposición transitoria era válida únicamente para ratificar a los funcionarios públicos, no así para destituirlos, incluso, el diputado liberal Wilfredo Navarro dijo que Ortega, en su reunión con Alemán en El Chile, tras suscribir el acuerdo con Bolaños, les informó que el consenso sería para ratificar los ministros y demás funcionarios, y nada más.

MANAGUA, Nicaragua — News reports from a variety of sources confirmed Tuesday that a high-level delegation from the U.S. State Department is seeking judicial permission from the Managua Tribunal de Appelaciones (Court of Appeals) to visit the Hacienda El Chile and meet with the convicted money launderer and ex-president of Nicaragua, Arnoldo Alemán.

Among the names on the list of proposed visitors are those of Barbara Moore, U.S. ambassador to Nicaragua, Carlos Garcia, political affairs officer at the embassy in Managua, Dan Fisk an important adviser to the Bush administration and specialist in Latin American affairs, as well as Oliver Garza, former ambassador to Nicaragua.

Reportedly, the visit to the home of Alemán is to seek a reunification of the right-wing elements of Nicaraguan politics and terminate the planned vote on constitutional reform that would strip President Enrique Bolaños of many of his powers. Bolaños is at his weakest point in his presidency and is under attack from all of the other elements of the Nicaraguan government including the national assembly and supreme court.

Alemán has refused to this point to negotiate or even discuss the proposals with anyone below ambassadorial rank and referred all prior overtures for meetings by the embassy staff in Managua to either his wife or daughter. Among the proposals purportedly on the table is a deal for a complete amnesty for his 20-year money laundering sentence in Nicaragua and no further action against Alemán and his family in the U.S. court system. The deal also includes a cessation of pressure against any of his deputies in the Assembly. Many of the deputies have close family ties to the Miami community and the restriction of U.S. visitor visas is a serious sanction.

Such a deal would require a rupture of the written accord signed by Alemán and Daniel Ortega Saturday outlining the alliance of the Partido Liberal Constitutionalista, headed by Alemán, and Ortega's Frente Sandinista del Liberación Nacional to reform the Nicaraguan constitution.

The two parties represent some 90 percent of the deputies in the national assmbly, an overwhelming majority.

To this point all sources indicate that Alemán is holding firm to his position, however, Nicaraguan foreign aid could be in jeopardy if he does not negotiate.

Sources in the Nicaraguan presidency issued a statement on Sunday that the Bank for International Development had frozen $15 million of Nicaraguan funding due to the constitutional crisis. This statement has not been officially confirmed by a representative of the bank.

Again, nothing exciting here. The news last night included Bolaños making his "State of the Union"-equivalent message to the National Assembly. No eggs tossed at him or anything. He did say, multiple times, that he was "the President of all the people of Nicaragua".

Much like King George II telling Americans that he is killing people in Iraq to make them free, Bolaños has a difficult position to sell. While he may feel that what he is doing (which, it seems, is humoring the US) is what is best, it just isn't feeding, educating and offering health care to the majority of the population.

The big "concern" is that the National Assembly will modify the constitution. Or, his big concern. This has happened before (When Aleman was President, I believe). These modifications (I believe they will be proposed later this week) would likely decrease the power of the President. Considering the President is one person and the proportionally-elected National Assembly better represents the people, why would this be a problem? Well, other than for Bolaños himself. A good guess is that any such changes would make it harder for an external government to influence national policy here.

The TV interviews included one with the President of the Supreme Court. It was very much on the level of explaining what the procedures were.

I have seen no news coverage of what is happening here from anywhere other than Costa Rica and Nicaragua. But, if such coverage happens it will be interesting to see how it is portrayed. What is happening here is that a bunch of well-dressed professionals are talking about political issues. There just aren't a bunch of revolutionaries running around threatening to shoot the next person they disagree with.

I have been watching major news sources today. I have seen nothing and, searching on the web, it is like Nicaragua vanished from the planet five or more years ago. I am sure once the U.S. state department can put together a story they will tell us all that Communists took over Nicaragua or something.

For a local perspective, there are seven houses on this block. I know the only phone in the block is my cell phone because virtually everyone on the block have asked to borrow it to make a call. Thus, I continue to laugh about the "survey" that La Prensa did.

But, maybe all the other people watch the TV news. Of course, I also have the only TV on the block. So, yeah, statistics. Sure are fun.

Note that the same sort of surveys are done in the US. Typically, while they don't say this, you end up with a survey of two-parent families where one parent does not work because they call homes during the day.

Nicaragua power struggle may invite foreign troops Special to A.M. Costa Rica

A constitutional crisis is rapidly building in Nicaragua as opposing political forces are creating pressure on this young democracy.

The situation is so bad that President Enrique Bolaños says he may bring in foreign troops from the Organization of American States to support democracy.

Bolaños is in the political minority. Sunday morning Rene Nuñez of the Frente Sandinista de Liberación Nacional was elected president of the Nicaraguan national assembly. The vote count was 83 votes in favor and only 7 in opposition to the candidacy. The dissenting votes came from the few deputies still loyal to Bolaños.

Live television coverage of the event reflected the curious sight of the former Contra leader and next president of the national defense commission, Fernando Avellan, praising the candidacy of Nuñez.

Nuñez is a militant Sandinista and close confidant of party leader Daniel Ortega. While the vote was going on party members of the right wing Partido Liberal Constitutionalista and left wing Sandinistas exchanged party flags in a demonstration of support outside of the Assembly building located in central Managua. The remainder of the Junta Directiva was elected in similar fashion with members of the two parties dividing the seven member Junta with a 4-3 majority for the Liberals.

The critical position of Assembly first secretary was placed in the hands of a family member of the imprisoned former president, Arnoldo Aleman, to assure duality in the new power sharing arrangement.

During the past week the executive branch of the Nicaraguan government and, in particular, President Bolaños were directly challenged by a coalition of the Sandinista led by Ortega and the Liberals led by Aleman.

Aleman and Ortega are former presidents of Nicaragua and undisputed leaders of their respective parties. The two political parties control 90 percent of the membership of the National Assembly of Nicaragua and jointly received 92 percent of the nation’s votes during the recent municipal elections.

The challenge consists of a series of announcements and legislative appointments which outline a broad agreement for governmental and constitutional reform in Nicaragua. The fundamental change is the weakening of the presidency of Bolaños and the institution of a parliamentary democracy.

Bolaños in essence is fighting for his political life as well as his personal freedom as he has been implicated in a campaign finance scandal that is under judicial investigation.

In an extraordinary reaction to the reforms proposed by the new majority, Bolaños responded by the filing of a series of lawsuits seeking injunctions against the legislative branch in the Nicaraguan and Central American court systems. Bolaños has also orchestrated a diplomatic assault on the character and legitimacy of the membership of the national assembly.

The Nicaraguan Supreme Court has unanimously rejected or delayed ruling in all of the actions for injunctive relief filed by the President and his cabinet members. The Nicaraguan court system is controlled by members of the two majority parties but, in particular, is dominated by members of the Frente Sandinista.

The Nicaraguan Supreme Court is divided equally between members of the FSLN and the PLC. Bolaños has also filed a similar lawsuit seeking a restraining order against the Nicaraguan National Assembly in the Central American Court of Justice, a regional judicial body which contains members from four of the six Central American countries. This claim has met a better fate, resulting in the equivalent of a temporary restraining order against the assembly directing the delay of any further reforms pending a full hearing on the merits.

The legitimacy of this order is subject to two serious challenges. The first is the extent of jurisdiction of the regional court to decide a Nicaraguan constitutional matter. The second is the validity of the membership of the judges on the court. All of the members of the court who issued the order had their terms expire last October and are operating the court without current legislative approval. Notwithstanding the legal problems of the Central American Court of Justice order, Bolaños has seized upon the finding as a tool to intensify diplomatic efforts and initiate negotiations with the head of the Nicaraguan Army asking to use armed force to disband the other two branches of the government. Direct military support by the army is unlikely as they have publicly stated that they would not intervene in "political matters" Bolaños met with high ranking members of the army and police force seeking support in a declaration of a state of National Emergency. Informed sources from both the liberal and Sandinista party stated that the appeal was rejected by military and police forces due to the lack of a rupture of constitutional order.

Bolaños also made a direct appeal to the Organization of American States for protection against the potential reforms. The OAS has the authority to employ coercive measures up to and including the introduction of armed troops to avoid a breach of constitutional order. Bolaños enjoys a large reserve of political capital in the OAS and with the U.S. government which dominates the body.

The U.S. Embassy in Managua and the State Department has remained publicly quiet but has been working hard behind the scenes seeking to shore up support for Bolaños among other members of the international community and pressuring Liberal party members of the national assembly to accede to the Bolaños line.

Amongst the pressure tactics allegedly employed are threats to revoke visas to visit the United States as well as the threat to initiate criminal money laundering proceedings against Aleman and his family members in the United States federal court system under the auspices of the Patriot Act and other provisions of federal law.

Aleman has allegedly been under investigation in the Southern District of Florida by a special anti-corruption task force of the Justice Department and U.S. Customs. Aleman was convicted of money laundering in early 2004 in Nicaragua and is serving a 20-year sentence in his farmhouse-jailhouse "Hacienda El Chile."

Saturday morning a local Managua newspaper, EL Nuevo Diario, printed a joint communiqué signed by Aleman and Ortega rejecting the validity of any armed intervention and implicitly threatened the removal of Bolaños if he failed to recognize the authority of the national assembly to amend the constitution.

In response to the communiqué, Bolaños in a surprise weekend press conference defiantly challenged the members of the assembly and declared the communiqué a "disgrace to the majesty of the national assembly" He also directly stated that the intervention of the OAS in his judgement would not consist of a derogation of Nicaraguan sovereignty due to the authorizing treaty and the aid supplied by the member states to the Nicaraguan government.

Later in the day after meeting with high ranking members of the Catholic Church, Ortega stated that "If Bolaños continues with a plan of foreign intervention of Nicaraguan sovereignty he will be removed by the National Assembly and be replaced by Vice President Jose Rizo Castellon".

Rizo who has repeatedly threatened resignation from the Bolaños government held a secret meeting on Thursday night with Ortega and later on Friday with Aleman allegedly seeking their joint support in the event Bolaños is impeached and removed from office.

Monday morning the President is required by law to address the Assembly and present his report on the state of the Republic and his legislative plans for the upcoming year. The tension is such that it is widely predicted that he will not appear or that a direct confrontation will occur during or after the speech.

Supporters of Bolaños have obtained a demonstration permit for a rally outside of the assembly during his scheduled annual report to the deputies. This report, mandated by law is the functional equivalent of the State of the Nation address given annually by the sitting U.S. president.

There is no confirmation to this moment of the attendance of the Nicaraguan president at the legislative session and counter marches have been discussed by members of the two majority parties. High security is planned for the event as the entire diplomatic corps is invited as well as the members of the Supreme Court and judges.

So, anyone see anything in a reliable news source? Lots of politicians have been calling for Bolaños to resign for ages. I don't know whether he is a crook or just not a politician (when asked about getting the retirement pay as VP and the pay as President his response was, "It's legal, isn't it" which makes me think he is just not a politician) but he sure isn't popular.

The left-wing/right-wing description above makes me laugh. We need to remember that the U.S. government set the standard for parties across the spectrum joining hands to defeat another party when they created and funded UNO to defeat the Sandinistas bid for a second Presidency in 1990.

Nicaragua has proportional representation, something that most people in the U.S. don't understand. Thus, a system with more than two parties can actually get something done. Other than the current President being rather unpopular, which isn't new, I don't see any reason to be concerned with the end of democracy here--unless the US decides to "help" again.

Nicaragua Property Reforms Worry U.S.

GRANADA Nicaragua – A controversial new property law designed to resolve title disputes over properties confiscated by the revolutionary Sandinista government in the 1980s could jeopardize the continuance of U.S. aid to Nicaragua , according to a U.S. government official.

The 42-article “Law to Create a Superintendency of Reformed Urban and Rural Property” calls for the creation of a Superintendent's position to resolve all pending title and compensation disputes over properties seized by the Sandinistas. The bill is being studied by the Congressional Economic Affairs Commission, and is expected to become law in the coming months.

The measure is being excoriated by the Casa Presidencial and independent lawyers, who claim it is an attempt by the Sandinistas to further legalize property seizures from their infamous land-grab in the late 1980s, known as the “piñata.”

If such is the case, the new property law could spell the end to U.S. financial assistance to Nicaragua by as early as July, when the U.S. votes to renew its aid programs, an embassy source told The Tico Times.

REAL estate agents, however, are looking at the bill through rose-tinted glasses.

The new position of Property Superintendent, they argue, would expedite the pending property cases, thereby offering definitive titles to previously risky real estate and making it safer for a buyers' market.

“This (law) could help a lot because right now there are some interesting lands without clear title,” said Billy Hondoy, legal analyst for Coldwell Banker's office in Granada . “There are people who want to buy some of these lands, but can't.”

Hondoy estimates around 25% of rural properties, especially in the north of the country – where foreign buyers aren't generally looking – have disputed title claims. That is down from around 80% in the early 1990s, he said.

In urban areas, an estimated 10% of properties still have tricky title histories.

DISPUTED properties are the lepers of the real-estate world. Even seasoned agents who know how to navigate the legal system usually stay away from seized lands, homes and buildings.

Veteran U.S. real-estate agent Charley Southwell, of Remax Granada, claims many of the pending land quarrels from the 1980s are still unresolved because the disputed property was stolen by one owner before being seized by the next, resulting in a sticky situation where no one can prove a convincing title history.

In instances where disputed lands are too attractive to pass on, some buyers have actually paid both alleged owners for their various title claims to the same plot, Southwell said.

But most of the time, real-estate agents and knowledgeable buyers avoid controversial properties.

FORMER Sandinista President Daniel Ortega (1979-1990) and his politically faithful are alleged to have rewarded themselves with as much as $2 billion in seized properties (land, buildings, homes, equipment) during the so-called piñata grab on their way out of office in 1990.

While much of seized property was previously owned – or stolen, as the case may be – by the Somoza family dynasty that ruled Nicaragua from 1937-1979, many of the other properties were held by families, individuals or businesses with lawful claim.

Since opening its Property Claims Office in 1995, the U.S. Embassy in Managua has helped resolve more than 1,000 U.S. citizen claimants recover seized properties or receive compensation from the Nicaraguan government, which has dolled out more than $277 million in compensation bonds during the past nine years.

An additional 762-embassy registered claims are still pending, according to the U.S. government.

DURING an interview last October, U.S. Ambassador Barbara Moore told The Tico Times: “We have made excellent progress under the Bolaños administration, and had a couple of record years in the number of cases re-solved” (TT, Nov. 12).

With the Sandinistas allegedly posed to assume influence over the new Property Superintendendency, the U.S. ' heyday for resolving cases may be coming to an end.

“We are indeed concerned about this,” said the embassy source, who asked not to be named, adding that the U.S. government is continuing to meet with different sectors to find out exactly how the new legislative initiative could affect future property claims.

THE Casa Presidencial is less reserved in its contempt for the bill.

“The same people who destroyed the country in the past are now the ones who are saying they are going to fix it,” said presidential spokesman Lindolfo Monjared.

President Enrique Bolaños is expected to veto the law after it passes its second vote in the National Assembly sometime this year.

The president called for a national understanding that would help Nicaragua move from the current constitutional crisis that could bring the country to the edge of armed conflict.

However, the assembly is poised to ratify a reform of the government that would turn the country into a parliamentary democracy. Already the body has stripped the president of the power to appoint a minister.

Let's think about this. Under Somoza(s) Nicaragua had an unpopular President. He was supported first by foreign military but then got foreign money to build his own military.

So, now, Nicaragua has an unpopular President who is threatening to call in foreign military to support him unless the popular legislature does what he says.

So, what's the question? Will the US lend serious support to undermine democracy in Nicaragua again? (That is, beyond to ongoing use of US money used to manipulate Presidental elections.) Will the National Assembly do their job representing the wishes of the people? ...

I wasn't here when Bolaños was elected but I heard the issues. He ran on an anti-corruption ticket and Aleman is certainly an example of corruption. But, had the US not seriously invested in Bolaños, it is likely that Ortega would have won. Thus, it is a little hard to justify that the current President represents Nicaragua. (This is not to say that Bolaños is not acting in what he feels is the best interest of Nicaragua. It is just not what is the popular opinion here.)

Personally, I am all for letting Nicaragua make their own decisions--right or wrong. Only time will tell if the US gives them that chance this time. The main thing that is different today is that a lot of nationalist governments are in place in Latin America which makes it harder for the US to just stomp here and not get caught.
