Horse's Mouth about Santana's Problem

I emailed David Gordon because "Santana" has posted that she paid for land in Rancho Santana and can not get her deed after she and/or the "Golf Pro" paid for the lot.

I'm very concerned because anytime that I've done any property transactions in Nicaragua; I've received the deed and all legal papers when I put my money on the table. This Rancho Santana is a new wrinkle for me on legal business and property business in Nicaragua. "fyl" say either spend the time to save the money or spend the money to save the time.

NicaLiving (our website) gets over a million hits per month from people who speak English and who have interest in Nicaragua.

"Santana" is a valued member on NicaLiving and she paid her money for her property over two months ago.

Your website says that the deed will be given to the buyer on closing; but, this woman and her golf-pro husband have never received their deed.

These people are from Stony Brook in Long Island, New York, and they paid their money and have received no deed and the two of them can not come to Nicaragua every day day to look for their deed. Santana is busy on "NL" and her golf-pro husband is doing some next thing and they have no time and/or don't care about the deed.

I personally would like to see her get the deed to the lot at Rancho Santana and maybe she will post on that subject and quit bashing the Atlantic Coast of Nicaragua.

BTW/ I've got 3,900 acres of land and the deeded title on the Rio Coco that we can develop and I have no deed problems there. You have me email - Let's rock n roll.

On NicaLiving, we recommend many properties; but, this question must be be answered before we can speak good things about you and the property.

Please answer as soon as possible.

Registered Escrituras

Everyone....please settle down. As I know the proceedure, after all the due diligence is done, etc, you go to the lawyer. The lawyer prepares a Testimonio that lays out all the details of the sell and the property. Buyer and seller sign. The lawyer prepares the escritura and it, along with the plot plan, are registered at the catastro and registro. Once that is done, you get your escritura. This process can take many months. Mine took 8. Currently in Rivas department, it takes a minimum of 3 months without "expedite" money.

A testimonio is not a deed. A titulo is not a deed. A registered escritura is the deed. It legally shows the new owner.

I'm not calling anyone names. I'm not saying anyone is lying. I'm not saying anything about anyone. BUT, this is the procedure here on the Pacific coast. I don't know what the procedure is on the Atlantic or if it is different or much quicker.

If someone buys property from an individual owner I believe your scenario is about right.But if you are buying into a comunity with 100s of lots,I would think the "expedite" money would be included in the deal, as any developer knows how important it is to get the deeds out ASAP.(Its a huge selling point.)Most people buying property in a foreign country would be more than happy to pay the "expedite" money to see the deal closed ASAP.But in this case the developer has to have it to sell his property in a timely fashion.What if you buy a lot and want to start building immediately?Nobody is going to start building without a deed.

I Know Nothing

If I put my money on the table for a private lot/land from an individual or in a sub/division or wherever; I want to get the deed and done. My lawyer will be there and I will not put money if the deed and paper work are not correct.

How long...

A question: How long does it normally take for the title deeds to come out of the registry. You say Santana paid for the property 2 months ago...that would be really quick...anywhere in Nicaragua. Anybody got experiences on how long it takes? Does Alan know any person that is living in Rancho Santana...who has bought land, has built a property there?

I emailed Tom Gordon on May 15 and asked how long the purchase process takes, from the transfer of money to having the deed in the buyer's hands.

No answer as of June 4.

If I were in Santana's shoes, I'd be paying for long distance phone calls and expending her considerable persuasive talents talking to Rancho Santana.

Then maybe calling Paul Tiffer.
