Eviction

A while ago, My wife rented to some people a house in Monsenor Lescano, Managua. Told them we were going to sell the house in a month so that we could construct a house in Huehuete. 6 months later they refuse to leave. we let them live there at at fraction of the normal rental costs. Now they refuse to leave. Our lawyer told us to take possesion of the house at this time (just go into the vacant apartment and enter the main house). It takes 4 to 6 months for the police to remove them. I have concerns about problems with the renters so I was thinking of taking a pistol for protection (I have the permission for carrying the gun for self protection). I will probably just leave the pistol in the truck just in case. Any comments? Just want to know what you think. These are belligerent people who have a history of taking advantage when a house is for sale. In any case although I dont know what to expect, I will be there with 4 others to do it.

The woman of the house had the knife and somebody took that away.

I saw the woman who I think is your lawyer wearing the black baseball cap.

The whole thing on TV lasted about one minute.

That was her... I was going to the police at that time and came back after the shot. The laywer for the tennant afterwards broke into the house....broke the front door and the garage door without even talking to us. Beat up my lawyer and then told me maybe we could pay something to make them leave.... I think I will pay something like 300 dollars for them to leave if thier lawyer pays us about 5000 dollars for the damage. Truthfully, the money doesnt mean anything to me right now. I would rather pay money to the police and the Jues to solve this.

Truth is that I dont really care. What is more important to me is that my friend and my lawyer is ok. I can postpone my plans if necessary, but the people I care about are more important my friend than what I want to do.

Yes she is beautiful, and a Bulldog when it comes to the law. Its even hard to get her to give bribes. She is a Sandinista....think she is a true believer. Very Bravo and I would recommend her to anyone.

Alan there is a Dealer and Mechanic specializing in 60-70's Land Rovers in Monsenor Lezcano. I have heard he can convert any Land Rover to make it fly or float.

From Monsenor Lezcano Church I was about 5-6 blocks down, there is a Billiards on the left hand side, you take a left down there and its on the opposite corner. I still have many good friends on that street.

No,Alan, its not near Huembes, its in Monsignor Lescano. Its a Barrio in Managus with lots of problems with drugs and gangs. My wife's grandmother lived there before the revolution and Ileana inherited it when the grandmother died. So now some Sandinista peraso de mierdas are trying to take it. Turns out my wife has all the papers including registration. The other lawyer is trying to say that she never had registration and that his client is owner. No chance. My wife has everything.

I understand that the people dont belong at your place, but maybe even if you lose a few bucks out of the deal, how about a different option:

Offer the family that is living at your place, to pay for the first month rental at another house. It will set you back $100 but at least you wont have to deal with all of the head aches that they could cause after you kick them out (ie Destroying the place) I know that there are several houses in the barrio for rent.

I used to live at:

Monsenor Lezcano de la foto luminton 5 1/2 cuadras al lago in the 2 story yellow apartments on the corner lower apartment.

This place is probably a little to upscale for these people, but for the 3 bedroom 2 full bath house with garage it cost $180 a month.

I wish it were a matter of a few bucks. My lawyer says it can take up to a year to get them out through the courts, and these people have evidently done this scam before. I am going to take the advice of an earlier post and try to hire some police directly. All the paper work has already been done to prove ownership and to order them out so hopefully that will work.

Guess I am confused why one would rent a house for one month, to unknown people, if a sale was pending or hopeful or whatever. Doesnt matter now. Might be too late now, but if you had access to a video camera of any kind, you might consider using that when you tell them they will vacate the propety in 72 hours, or whatever it is, or could be. Keep the tape, you never know. Then go there and remove them , again with the camera. Take more than 4 others, if you can arrange that; take your lawyer, too, if you can arrange that, and have photocopies of your ownership papers with you. If you suspect there will be a "scene" then there probably will be. If you really cannot get them out without shooting them, and if you have no property inside, you might consider removing all the doors to the building (take them off the hinges, and take them with you). I have seen it done before. It is a good "hint". If there is to be a real ugly or even violent confrontation, it might be in your interest not to be there, and have people handle it for you (all the easier if there are no doors!).

Do You Have a signed Lease? if so, you are required to give them a month from the end of the lease to vacate.

Pete has a good point, go to the police and explain the situation to them, that way the police will know first hand what is going on.

Nope, no signed lease except for the recipts...but many people know of the agreement and that the sign se vende has been on the house for 6 months. I do know some police, that is an option....

Usually getting the police to do the dirtywork for you, and hooking them up with dinner or some cash, will get the job done. and it will relieve you of the responsibility for shooting someone.

and after they are out dont remove the doors as mentioned (your toilets sinks and everything else will disapear) rather weld everything shut. :)
