Pelican Eyes closed?

A former resident of SJDS (Nica) who now lives in Massachusetts reports that she received a phone call that Pelican Eyes is closed -- possibly something to do with land ownership -- though this is third-hand info. She is very concerned because of all the locals that Pelican Eyes employs. Has anyone heard anything so i can report back to her?

I don't get it

Why are people constantly putting up old posts about Pelican Eyes that are no longer relevant. It just starts rumors and confuses people.

Forgive me if I'm dense. this post regarding Pelican Eyes is from May 2006. How come it's a current topic October20th 2006. I am genuinely interested as I have a friend who has invested there and doesn't know anything about N.L. I Would hate to call him up and not know what I'm talking about, also hate NOT to call him if there is a problem. What Gives?

Malicious and erroneous statements regarding Pelican Eyes...

To all readers of the Nica Living site: We at Pelican Eyes...Piedras y Olas are aware that these malicious and erroneous paid opinion letters from Silvania Sandino have been published in the Nuevo Diario newspaper. We have filed on October 20th, 2006, a slander lawsuit at the 7th Local Criminal Court in Managua, Action No. 725-207-06, and we are confident that if Ms. Sandino does not retract, we will obtain a conviction against her and those involved in these actions.

Other information, such as that posted by "lanica" to this site is also incorrect (as were her postings saying our hotel had shut down back in May, when that was clearly and obviously not the case). We believe she is working with the Sandino Family in order to attempt to damage our hotel and our management team publicly, as the Sandino Family has lost any chance of prevailing in the court system - so they are using slander and erroneous information to try to plead their case publicly instead of following the proper legal channels.

Please let this serve as notice to any of our investors and friends that all of the landholders and developers in San Juan del Sur will prevail with the law. We are confident of this now, as we were in May of this year when this began. We regret any undo concern that this latest "propaganda campaign" may have caused you. Let me tell you first hand...

ANY CASE IN THE COURT SYSTEM IN NICARAGUA will NEVER go against labor or a local when outsiders are involved...

In this case title search was not properly done and in the end those investors WILL LOSE what one judge does in favor of investors this morning...Can be undone by another in the same afternoon.. again been there and done that.

These people do not care and will tell you to your face, those that are honest.. the little guy always wins.. NO JUDGE in Nicaragua will crush the little guy.

Oh yeh, local phlisolsphy, Don't worry about killing the chicken today, There will be another one along tomorrow.

I know there are exceptions to every rule, so really good luck.

Disputes

Know nothing of this case but, In Granada disputes between gringos and locals taken to court will almost always result in the local winning.

This is the way it is in Nicaragua. I am referring to employment and land disputes (easements). Window on someone else's property or an employee that was overpaid from kind gringo's.

They didn't document what was being paid and the time she took off. She left got lawyer and sued and won $4000.00 from employer and she was already being paid twice what the position was worth.

Another case investor purchased 2km beachfront and built road from main road to beach dividing property in two. Goverment took road after 1 year claiming it was public right of way. This was a blow to his development plans.

Back in 1995-1999 a group of gringo investors bought a big hunk of land on the bay and built a big seafood processing plant fully operational and ready to go until they found out they didn't own the property and lost the whole works.....

Sandinistas vs. Nicaraguans?

What I am hearing is that what the Sandinistas did in the 1980s sounds like "how it is" in Nicaragua. That is, "unjust", for some value of that word, confiscations happen here.

If that is the case, that would worry me (as an investor) a lot more than what a revolutionary government did 20-something years ago while being invaded by the big guy up north.

Perhaps the lesson is this

If you buy land that might have been confiscated, don't build anything fancy on it. If you do, the original owner will naturally want it. If you build just another average Nica building on it, he has less incentive to want it back. Makes a good case for "blending in".

I have seen many situations on a smaller scale where the only recourse when buying Sandinista confiscated property is to pay off the original owner. In these cases the original owner settled for about 10 cents on the dollar. It will be interesting to see (if Ortega wins) Which side he will support.

Have those people that invested in Pelican eyes lost? What about Rancho Santana, I think that was another one of those questionable properties, Not even sure if they ever provide titles. Perhaps I got what you are saying wrong, that if these people negotiated and paid the real property owners a "Fee" then they might retain their propertys.

I find it amusing

that certain people whine about how unfair the USA is when dealing with other countries, then expatriate themselves to a place that treats them like this.

...reading the article in 'Nuevo Diario' I'm confused about just what's going to happen to the land the 'foreigners' have bought. Part of that article indicated that their posession is '...totally illegal...' but another part seems to say that the 'Law of the Reformed Property' says that whoever acquires the property in good faith, at third hand? (maybe these 'foreignors') cannot be touched.

i tried the translation, and am still awfully confused. i got an email from chris that seemed to say things had settled down, but that was last week; this nuevo diario article is dated today, so now i wonder if things really are settled. i remember sending through translation an article about land and since the article talked about manzanas, there were loads of references to 'land apples' - i was scratching my head wondering what that was all about until i realised this was literal translation -and hence the 'german' when referencing the Fat Man. gotta love this stuff....

A while back I used the translator for the first time & I could not figure out why the hell apples were so expensive in Nicaragua, or why these apples were so important & kept being mentioned in the story I translated. I finally figured it out & realized what a dumb a.. I am.

Pelican Eyes is Open and Fine

I wrote a long post earlier, but it seems to have gotten lost in the ether. I spoke to the owner of Pelican Eyes in the last 24 hours and all is fine. The situation that is being referred to is a legal situation relating to property ownership, and went all the way to the Supreme Court. It has nothing individually to do with Pelican Eyes, but with all the land surrounding the hills of San Juan del Sur (affecting Pelican Eyes and many other residents and investors). It's all rather technical and convoluted, but the net net is that the current owners are still in legal possession of their land, and while it's been a tense week in SJDS, all is slowly returning to normal. Pelican Eyes is open and thriving, and has been since its grand opening in 2003.

The good part about this entire scenario is that as a result of this legal situation (or "a court order gone wrong" as the owner of Pelican Eyes so eloquently put it to me), the property rights laws and regulations in Nicaragua are likely to be further strengthened --and both local residents and international investors will benefit tremendously. As with any foreign country, property rights can be murky and confusing - as they differ from region to region, and often from administration to administration. Nicaragua's own political history complicates things further, so this particular situation, while having caused some unnecessary angst this week, helps shine a light on the importance of fortifying land rights and keeping the doors open for investors and future developments. These are all very important for the country.

Pelican Eyes

I don't know how much of this is true, but what my wife heard is that an owner of the land, before the Sandanistas took it away from her, showed up at Pelican Eyes with a member of the Sandanista government and some guards to claim her land. Apparently, the residents of SJDS are organizing their own security to keep this person away from the property, because of the problems it would cause for the job situation and investment climate. Hard to say how all this is going to work out, but that is all I know for now.

My wife heard from a local that there are indeed ownership issues at Pelican Eyes, but don't have all the details yet. She said that the owners and residents were all going to Managua to try to straighten things out. Let you know when I hear more.

Update -- another friend just called Pelican Eyes and the front desk did answer. He asked if something was going on there, and they replied "yes", but they aren't able to talk about it. What's going on there?

I'm actually staying at Pelican Eye and using their wireless connection ,the only problem that I see is that the main pool was being remodeled and the light went out last night and it came back around 2 am, and the main entrance was kind of a turn off because they are paving the street, regular business as far as im concern , restaurant is open , the other hasle was that my room did not have a telephone , it apparently broke. and when I asked the reception she asked me in what room I was staying , when I told her she said this room did not have a phone, im wondering how come it had a phone jack but no telephone.Yesterday I ran into the guy from Guatemala that was remodeling the pool at the bar by the other pool that you have to drive to, he said that the main pool was almoist done and only had a day work, today in the afternoon was already being filled. I also noticed construction of new rooms being built , so I dont know how much is tru about this rumor.

Pelican eyes is closed their are armed guards preventing any supposed land owner from entry, I left this morning the person i rented my room from has a lot and has attempted to go their every morning for a week on his motorcycle. It's a pity that the wrong gossip can be chanelled so rapidly and incorrectly and as a resident in Nicaragua, I can only attest that we do live in a gossip-driven society here, I never thought that an expat or visitor (in whichever category the author is) would be the instigator of this.

I am writing this email to help alleviate concerns regarding the recent eviction action commenced by a party representing the Sandino family against the developers in the area of San Juan del Sur.

First, it should be emphasized that all are working together diligently to resolve the issue without financial or property loss to anyone, the support has reached all the way to friends and colleagues all over Nicaragua and Central America for that matter.

To clarify: the Supreme Court decision was entered a month or so ago as the end result of a long standing dispute between the Sandino family and a third party. Apparently there was a forged Power of Attorney involved that allegedly conveyed Sandino titles to third parties. The Supreme Court decision was entered which stated that any deeds that he received as a result of the forged Power of Attorney were null and void. The court order said that he should give back the possession of the land to the Sandino family. The litigation was solely between the third person and the Sandino family. The litigation did no address the issue of who had title to the land.

This is a case where the Supreme Court decision could lead the police or military to believe that they could evict someone, but this act would not be legal. The title holders of the land were not a party to the litigation, there was no due process as to them and there was no finding of title in the Supreme Court decision. Regardless of legality, an eviction did take place, however, not at Pelican Eyes.

The support of the workers and townspeople has been very moving. The police have been directed not to participate. The judges have been directed not to act. The path has been cleared for a counter judgment to be issued declaring the first one null and void and creating, such is possible in this legal system, a precedent against future actions and guaranteeing all the titles.

I hope the author of that first message does not jump to such a platform of readers if (s)he has not even taken a closer look at the real situation.

To conclude: Pelican Eyes has never been closed and all owners of all villas and lots never have had restricted access to what is theirs.

YES, there was a court case that created some question around property rights in the Lomas de Sandino (the hills surrounding San Juan del Sur). The facts of the case are under dispute and the issue is being quickly resolved. The current landowners in this region are and remain the owners of their land. Chris Berry and the owners at Pelican Eyes are in possession of their land, as they have been for many years, and the hotel is open.

NO, there is no cause for speculation and wild rumors. While this legal situation was unfortunate, it was also ill-founded and the facts will prevail. In fact, there are positives to this situation in that representatives throughout the country, including the tourism board, minister of tourism, the local mayor, investment groups, local residents, political officials and others are now seeking to strengthen property laws for the future. The group in San Juan del Sur is a large part of making this happen - and the entire community is involved. This is important for San Juan del Sur and for all of Nicaragua and its future growth and development.

Please do not spread rumors or untrue facts. It is unfair to the parties whose livelihoods are at stake and to the entire community of San Juan del Sur. This is a vibrant and growing community and one that is interdependent on one another.
