The following is a specific answer by Paul Tiffer to a question here but is of general interest.

Some clients wrote me asking about a Nicaliving art, or question, in my opinion it´s could be useful if I had this general answer:

According to Nicaraguan Civil Law, anybody can leave properties through a Public Deed called a Testamento, prepared with a Nicaraguan Notary. It is the equivalent of a will in the USA, but with more solemnity. It is necessary to do it in front of three legal witnesses. In the Testamento the owner of the property can appoint the heir or heiress. It could be a Nicaraguan, American, or any other nationality. The person is going to express his or her last will or desire.

On the other hand a will from USA, or any other country, is legal in Nicaragua, but it is necessary to do the proper authentications, translations and registration in Nicaragua. For that reason, it could be more useful, cheaper and easier for the heiress have a Nicaraguan Testamento, for the properties in Nicaragua.

The wife and I are mostly through residency application. Paul Tiffer is everything people have stated and more. It was never expected to go smooth but pauls prompt communications by email while we remained here in usa to supply all he needed was reasonably quick compared to what we've read about. Fedex of documents to Nica is not cheap but this is the way to go.

RESIDENCY

RESIDENCY

Getting residency can be one the hardest parts of living in Nicaragua for many people, and lack of information is one the reasons.

It is imperative to know there are three ways to get the residency.

1. As Investor 2. As Retiree 3. As worker

In all of these cases, the applicant must prove this status and submit supporting documentation, as well as the general documents of any foreigner namely:

* Birth Certificate * Police Record * Health Certificate.

These three documents must be from the applicant's country and MUST be authenticated by the Nicaraguan Consulate in the country where the documents where issued. To get the authentication in USA, for example, it is necessary for the County Clerk to notarize and authenticate them. This is for Canadians too, and because there are no Nicaraguan consulates in Canada, they must authenticated in Canada and sent to the Washington consulate of Nicaragua.

Then these authenticated documents must be authenticated in the Nicaraguan Foreign Affairs Ministry and translated into Spanish with a Nicaraguan Notary, to be submitted to Immigration.

The same procedure must be followed for retirees, with the document of annual pension to prove they have the minimum income required for the Nicaraguan law.

At the moment, this procedure I just told you, must be followed by everybody. There is no possible way to submit documents issued in Nicaragua (police record or Nicaraguan health certificate are not valid for foreign people to get residency) and finally, no one can submit any document to Immigration or any other government offices without the proper authentication I just explained; that is the law.

Another possibility is if somebody marries a Nicaraguan. In this case, this person will need to submit the whole documentation above (Birth Certificate, Police Record, and Health Certificate), and must submit this additional information:

* Copy of the ID of you husband/wife * Marriage License * Support Affidavit (the spouse must declare he/she will support you in Nicaragua) * Labor contract or any certification from your spouse’s job.

Consulate General Of Nicaragua in Miami

I recently submitted 5 documents, police history, health certificate, divorce decree, copies of passport and birth certificate. 3 out of the 5 got authenticated. The health and passport need to have a State "Apostille" I then asked if I could bring these two documents with the apostille, if I could get them authenticated in Nicaragua I was quoted “yes” now I’ve heard mixed information on this. Is this true?

Immigration

The photocopy of the whole pages of the passport it doesn't need to be Apostille from USA, can be for a Notary in Nicaragua.

The Health and any other documents from USA, must be Apostille from USA, them the Nicaraguan Consulate in USA, any of them; and the Nicaraguan Ministry of Foreign Affairs.

The whole documentation must be translated into Spanish.

As a Canadian I did my authentification thrue the Canadian consulat in Managua and it worked ....And I would nt do business thrue the USA,,,simple healty choice.

Canadian Consulate is able the authentications of some documents, and it was great for you, my advise is to check in advance with the Consulate in Managua, otherwise must be through USA.

Paul, I've heard people tell of a category called rentista. Is this something that exists? Re pensionado - must the income being received be from a government pension or does a self administered RRSP (Canada) IRA (US) qualify. I've heard tell that only government social security counts for a pensionado. Though as the age limit for pensioner is 45, I don't see how anyone could draw a government pension before 60 years of age.

Indeed the Law named: RESIDENT PENSIONERS OR INDIVIDUALS LIVING ON INVESTMENTS ACT DECREE NO. 628 NATIONAL CONSTITUTIONAL ASSEMBLY OF THE REPUBLIC OF NICARAGUA, use in Spanish the name RENTISTA for people who have "individuals living on Investments" or private income from different sources.

These incomes must be permanent, ex: a Certificate of Deposit in a Bank for 5 years which the interested are over $ 400 per months.

Another example a Credit someone is going to pay you, a Mortgage for 5 years or more.

On of my clients sells his house in Canada and the buyer is paying in several years the price, instead to the bank, to my client and he proved and the Nicaraguan Government accepted.

It could be from a private company which is going to pay this amount ($ 400) or more for the next five years,

Actually there are several other ways.

About retire people under 60, could retire under especial conditions, such as: to illness, down sizing, member of the military, or people with any Health problem, and any other etc.

Early government pensions

It is not just social security but the more obscure the pension is, the harder it is to get it to "pass the test". For example, 20 years in the U.S. military or in many government jobs gets you a reasonable pension regardless of your age.

I don't know how an RRSA works but an IRA wouldn't because it doesn't meet the "for life" test.

I am buying property outside Leon and my son is doing the transaction for me. I do not want to send money until I hire another lawyer to make sure the transaction is legal and the property will be mine.

I asked Paul to do some work for me. He did it quickly and efficiently and kept me posted along the way. I'm a happy customer.

On the note with immigration questions, I actually discussed dealing with immigration with him a bit. His advice is to avoid lawyers when talking to immigration. His explanation, which makes a lot of sense, is that people in immigration don't make much money and when you show up with your "expensive lawyer" they are all the more likely to make things as complicated as possible for you.
