Residency through marriage - extra requirements

Hi,

I'm wondering if anyone can comment, through experience or understanding of the relevant documents, on something that has recently been indicated to me.

If a foreigner (married to a Nica) seeks Nica residency using the marriage as a basis, is there a requirement to demonstrate that the Nica has a substantial enough income to be able to support the foreign spouse? Even if the spouse has a freelance foreign income making that unnecessary?

Requisitos para los extranjeros con vínculo nicaragüense: Para los dependientes económicos, presentar declaración notariada de manutención, así como solvencia económica y fuentes de ingresos.

Incomes

Hello,

The government wants to know your incomes sources, however free-lance work is not consider by the law, so Immigration usually doesn´t accept it. If you already have a child it will prove you have more links in Nicaragua and will help.

One client of mine who was recently approved brought from USA, a Certified Contract from his employees, authenticated by the Nicaraguan Consulate; the certification proves he will still working in Nicaragua for a USA company.

My wife had to provide a notorized Compromiso (Carta) de Manutención proving her income.

The Lawyer that notarized that document also told her she needed to swear to the fact that she would take care of me.

When you go to buy the application form (Formularia) at Migracion, ask at one of the wickets for a checklist called Requisitos Para Solicitud de Residencia. The person should circle the items you need, they are numbered 1 to 35.
